Suffolk police said they arrested a Manhattan man Sunday in connection with a 2009 fatal robbery attempt in West Babylon.

Daniel Greenspan, 28, of East 20th St., was arrested near his residence Sunday morning on homicide charges in connection with the killing of Michael E. Sinclair, a Brooklyn resident who was shot to death Jan. 31, 2009, on Kellum Street in West Babylon.

Greenspan, who police say also went by the alias David Rivera, is the third person arrested in the case. He was charged with second-degree murder, police said.

In March, David Belton, 27, of the Bronx, admitted in court to his role in the killing of Sinclair and pleaded guilty to second-degree attempted murder. In return for his plea, which came after two previous trials ended in hung juries, Belton was sentenced to 10 years in prison.

During his criminal trial, Belton testified that Greenspan orchestrated a plan to drive Sinclair from Brooklyn to Suffolk County to rob him. Belton said Greenspan gave him a gun before the trip.

Belton testified that he, Greenspan and Greenspan’s girlfriend, Noriella Santos, got out of two cars on Kellum Street, where Belton held the gun and demanded jewelry from Sinclair but got nothing. Belton said in testimony that Greenspan then took the gun and shot Sinclair several times before the three fled.

Sinclair, 32, died on the street with his wallet in his hand, according to police testimony.

Santos is awaiting trial on a charge of second-degree murder in the case.

Greenspan was being held at the Third Precinct in Bay Shore on Sunday, pending his arraignment Monday at First District Court in Central Islip.
