Darrell Fuller trial: Witness recalls shots fired into vehicle on parkway

A witness at alleged cop killer Darrell Fuller's trial testified Wednesday that she watched him shoot into a car on the Cross Island Parkway as she drove by on a morning in October 2012.

"I think I just saw a murder," real estate agent Jodi Cohen said she told her parents after arriving at their home about 15 minutes later on Oct. 23, 2012.

Cohen, 51, a Nassau resident, said she dialed 911 twice while driving by at 50 to 60 mph and hearing two gunshots. But she said she wasn't able to get through.

Fuller, 34, of St. Albans, Queens, is facing first-degree murder charges in the deaths of Nassau Police Officer Arthur Lopez of Babylon Village and Raymond Facey, a 58-year-old construction worker from Brooklyn.

Cohen said it wasn't until several hours later that she again called 911 when she realized that TV news coverage of a police manhunt was connected to what she saw on the parkway.

"When I turned on the TV, it all came together, and I said 'Oops! I better call 911,' " Cohen testified in Nassau County Court in Mineola.

The witness also recalled seeing the gunman in a gray sweatshirt next to "a white sedan," but she said she didn't remember seeing any other cars by the roadside.

Authorities have alleged Fuller ditched his disabled car before shooting Facey and escaping in his car.

Prosecutors have said Facey's slaying happened minutes after Fuller was involved in a hit and run crash and fatally shot Lopez, a 29-year-old Emergency Service Unit officer, during a traffic stop at the Nassau-Queens line.

Cohen said during cross-examination she didn't recall if she saw a photo of the suspect who police were seeking in the manhunt on TV before authorities came to her home on the evening of Oct. 23, 2012.

"I may have," she told defense attorney Francis Quigley Jr. of Garden City.

The witness said police also picked her up on the night of Oct. 24 and took her to view a lineup. At that time, she identified Fuller as the gunman she'd seen on the parkway a day earlier.

Cohen also testified that she watched TV news broadcasts after police left her home on Oct. 23 and that she saw a photo of the alleged suspect.

In other testimony, NYPD Det. Rashida Jupiter said she retrieved Fuller's clothing and did gunshot residue tests on his hands at a Queens hospital.

Prosecutors have said Fuller had a friend shoot him so he could try to look like a third victim in the case. Police found him bleeding next to a minivan on 111th Avenue in Queens several hours after the slayings.

NYPD Det. Shimicka Meadows testified about recovering a bloody sweatshirt that authorities have alleged Fuller ditched elsewhere while on the run. She also said she found evidence, including a deformed bullet and bullet fragments lodged in the minivan, where there also was blood.
