The police videotape of Kim Wolfe confessing to fatally shooting her ex-girlfriend and her uncle, as well as shooting her grandfather and kidnapping her niece, will be allowed as evidence in her trial, a State Supreme Court justice ruled Wednesday.

Wolfe, a former Nassau County correction officer, made the confession while in police custody hours after the June 16 incident and spoke to a detective at length.

"The defendant was coherent, calm and detailed in her description" of the events, Justice David Ayres said during his ruling in Nassau County Courtin Mineola.

He also ruled that Nassau County police had "ample probable cause" to arrest Wolfe, 43, of North Babylon, based on eyewitness accounts from the shooting of her relatives. Ayres also ruled that telephone calls between Wolfe and a Hempstead police officer at the scene of the family shootings could be admitted into evidence, and that the police seizure of a 9- mm handgun found in Wolfe's lap at the time of her arrest did not violate Wolfe's rights.

"It's a proper and just decision," Assistant District Attorney Martin Meaney said afterward.

Wolfe's defense lawyer, Michael DerGarabedian, said the admitted evidence did not weaken the insanity plea he expects to argue.

"It has absolutely no effect. It's not what she did, it's why she did it," DerGarabedian said. "Throughout this whole hearing it's been obvious this woman not only was not appreciative of the consequences of her actions, she didn't know there were any consequences."

Patricia Bines, the sister of Wolfe's ex-girlfriend Stacie Williams, who was fatally shot outside Nassau University Medical Center in East Meadow, said it was chilling to watch the taped confession in court Tuesday.

"She has no remorse, none whatsoever," Bines said. "I just felt disgusted."

Wolfe has pleaded not guilty to two counts of second-degree murder, first-degree assault, second-degree kidnapping and second-degree criminal possession of a weapon. The case will be in conference on Jan. 12.
