NYPD: Commish to determine penalty for Det. Hassan Hamdy who shot unarmed motorist

A New York City detective from Centereach will go through an internal police disciplinary process for his role in a fatal 2012 shooting of an unarmed National Guardsman in Queens.
NYPD officials said Det. Hassan Hamdy should be served with departmental charges based on an internal review of the Oct. 4 shooting of Noel Polanco during a traffic stop on the Grand Central Parkway.
The process may result in a ruling from the Department Advocate's Office, NYPD Deputy Chief Kim Royster said in a statement Friday.
"The final decision regarding penalties will rest solely with the Police Commissioner," Royster said.
Hamdy told investigators he shot Polanco, 22, once in the stomach after he appeared to be reaching under his seat, possibly for a weapon. No gun was found.
Other passengers in the vehicle said Polanco did nothing to provoke the detective.
A Queens grand jury decided in February not to indict Hamdy.
A lawyer for Polanco's mother has said the family is considering other legal options.
