Hearing on Hamptons woman's DWI in June
The former Hamptons real estate agent who is accused of violating the terms of her 2011 DWI probation when she drank two glasses of wine at a Montauk restaurant was back in court Tuesday and was scheduled for a hearing next month.
Charlotte DePersia, 59, of Toilsome Lane, East Hampton, is being held in Suffolk County Jailin Riverhead on $1-million bond or $500,000 cash bail since admitting the violation in April. She declined to plead guilty Tuesday and a hearing was set for June 5. If convicted, she faces a sentence of 1 1/3 to 4 years in jail, authorities said.
Suffolk County District Attorney Thomas Spota said that since 2003 DePersia has been arrested three times for driving under the influence of alcohol, the most recent after a 2010 accident in Bridgehampton where, Spota said, she crossed the centerline and struck an oncoming car, injuring two women -- one of whom was pregnant.
Justice William J. Condon granted DePersia probation at her sentencing in December, but warned her that even a minor violation could cost DePersia her freedom. The district attorney's office said an ankle monitor detected DePersia had alcohol on the evening of March 10, registering a 0.039 percent blood alcohol content -- slightly less than half the legal limit for a driver in New York. DePersia had been told that having one drink, even if she didn't drive afterward, would be a violation.
