LIer Elizabeth Silver sues Barclays Center after patron falls on her at Billy Joel concert, court records show

An Oakdale woman has sued the operators of Barclays Center and a beverage vendor, claiming she was injured when a "visibly intoxicated" patron "fell violently" on her at Billy Joel's 2013 New Year's Eve concert, court records show.

Elizabeth Silver, who filed the suit Thursday in Kings County State Supreme Court with her husband, Lewis, required arm surgery after a man holding two cups of beer fell as he navigated the row above, the couple's attorney said.

The couple said the arena's upper decks are unsafe because the steps are "too steep," aisles "too narrow" and seat backs too low to serve as protective barriers, the suit said.

"She shielded her daughter and ended up taking the brunt of the impact," said lawyer Michael Castro of Smithtown.

The fan tumbled into the row below Silver but was not hurt, Castro said.

"He got up, annoyed that he had spilled his beer," he said.

The couple accuses the Brooklyn Events Center, AEG Management of Brooklyn and Levy Restaurant of violating laws by supplying more drinks to a man who was unsteady and smelled of alcohol.

"You just add alcohol to the equation, and it's a recipe for disaster," Castro said.

A spokeswoman for Brooklyn Events Center, which owns and operates Barclays Center, and an AEG spokesman declined to comment, saying they had not been served with the suit.

A Levy Restaurant spokesman did not return a call.

The suit does not specify the amount of financial damages sought.

Castro said the couple would like the upper decks redesigned to "save other guests from having this happen to them."
