A Hempstead man faces a Leandra's Law charge after he drove drunk with his 2-year-old son and left the scene of an accident at a Westbury parking garage, Nassau County police said.

Third Precinct officers responded to a call of a car accident at a parking garage at 1504 Old Country Rd. where one car, described as a gold 1999 Nissan Altima, had left the scene.

Police found the car on the second floor of the garage, parked in a handicapped stall with its engine running. The driver, Edas Funez, 30, of 27 Attorney St., was in the front seat and his son was in the back seat, police said.

Funez is charged with aggravated driving while intoxicated, endangering the welfare of a child, driving while intoxicated, unlicensed operation, leaving the scene of an accident and parking in a handicap space.

Under Leandra's Law, passed in November, the endangerment charge is a felony. The law was passed following the death of Leandra Rosado, 11, who was killed in a DWI accident after the minivan in which she was a passenger crashed on the West Side Highway.

Funez was scheduled to be arraigned Tuesday at First District Court in Hempstead.
