Usher's ex-wife Tameka Foster files for custody after son nearly drowns

A judge has scheduled an emergency custody hearing Friday at the request of Tameka Foster Raymond, whose 5-year-old son with ex-husband Usher nearly drowned Monday at the singer-actor's Atlanta home.

A lawyer for Tameka Raymond filed the request in Fulton County Superior Court on Tuesday and Judge John J. Goger approved it the same day. The court filing says the boy "suffered a near-death accident" while left unsupervised in a swimming pool at the Grammy Award-winner's home.

Usher Raymond V was hospitalized but is expected to fully recover.

TMZ.com, citing legal documents it obtained, said Wednesday that Tameka Raymond alleges Usher is out of town for professional reasons 85 percent of each month and has delegated responsibility for their two children, Usher V and Naviyd Ely, 4, to his aunt, Rena Oden.

Tameka Raymond is asking for decision-making power over the children's education, health care, religion and extracurricular activities, TMZ said, and additionally claims that Usher, 34, has fired every caregiver who was on staff when he was awarded primary custody in August 2012.

Also Wednesday, transcripts of the 911 emergency telephone call emerged. "I need an ambulance," Oden frantically told an emergency operator. "My nephew was in the pool, and I couldn't get him. I tried to get him and they got him now. They doing CPR on him," she said, reported Atlanta CBS affiliate WGCL.

After housekeeper Maria Diago also tried unsuccessfully to free the boy who was stuck in the drain, according to a police report, two workmen at the house, Eugene Stachurski and Benjamin Crews, responded to the women's screams. Stachurski administered CPR.

This is the second childhood accident the family has suffered in a little over a year. In July 2012, Tameka Raymond's son and Usher's stepson, Kile Glover, 11, died two weeks after being struck by a Jet ski in Georgia's Lake Lanier.
