The Manhattan real estate developer charged with driving drunk in an accident that killed his friend in Sag Harbor last summer has been indicted, records show.

Sean Ludwick, 42, whose indictment by a Suffolk County grand jury was unsealed Monday, is scheduled to be arraigned on the counts Jan. 4, according to court records and his attorney.

He is free on $1 million bond, and it was unclear which charges he faces during the arraignment. Suffolk law enforcement authorities could not be reached for comment.

Ludwick’s attorney, Benjamin Brafman of Manhattan, said he is not surprised but declined to state the charges against his client, who originally was accused of driving while intoxicated and leaving the scene of an accident.

“The indictment was not unexpected,” Brafman said. “Mr. Ludwick will enter a plea of not guilty when he is arraigned on Jan. 4 and intends to address the charges responsibly.”

Southampton Town Police said Ludwick, a resident of Manhattan and Sag Harbor and a managing partner and founder of Blackhouse Development, was driving on Rolling Hill Court East in Sag Harbor about 2 a.m. Aug. 30 when his 2013 Porsche struck a utility pole.

Police found the car and Ludwick some distance away on Woodvale Street, but Ludwick’s friend, Paul Hansen, 53, a real estate agent with the Sag Harbor office of Douglas Elliman, was found dead at the crash scene, police have said.

Police reported seeing Ludwick standing unsteadily outside his car and that a “strong odor of an alcoholic beverage was emanating from his breath, his speech was slurred and slow, his eyes were bloodshot, glossy, and hooded or partially closed.”
