Wine lands ex-real estate agent back in jail

A former Hamptons real estate agent is back in jail after admitting she had two glasses of white wine in violation of her probation for driving while intoxicated.

State Supreme Court Justice William Condon yesterday sentenced Charlotte DePersia, 59, of East Hampton, to 7 months in jail and 5 years of probation for the violation. She had been on probation since December for DWI, when Condon told her that if she slipped up and had even one alcoholic drink he would send her to an upstate prison.

Suffolk Assistant District Attorney Kate Wagner quoted Condon's words back to him while requesting the maximum of 1 1/3 to 4 years in prison.

"She has shown blatant disregard for court orders," Wagner said. "She has shown a blatant disregard for treatment."

But Condon said he would rely on the recommendation of senior probation officer Michael Bisonette to sentence her to time in the Suffolk jail's alcohol treatment facility and to extend her probation. Condon said the idea that an upstate prison was a harsher sentence is "facile and ignorant."

He told DePersia, except "for the ingestion of a glass and a half of white wine, you were doing well."

DePersia took a cab on March 10 to a Montauk restaurant where she had the wine, setting off an ankle alcohol monitor.

She got 5 years probation in December for a 2010 crash in Bridgehampton in which she crossed the centerline and struck an oncoming car, injuring two women -- one of whom was pregnant. She spent 37 days in jail after her arrest.
